Terms and Service Agreement
Effective Date: June 2025
This Terms & Service Agreement governs all photography and related services ("Services") provided by PixelPoint Photography ("Photographer," "we," "our," or "us") to you, the client ("Client," "you," or "your"). By booking or using our Services, you acknowledge that you have read, understood, and agreed to these terms.
1. Scope of Services
PixelPoint Photography provides real estate photography, videography, drone imagery, floor plans, and basic editing for marketing purposes only. Services include, but are not limited to, interior/exterior photography, aerial drone work, CubiCasa-generated floor plans, and video/photo editing. These media products are not intended for architectural, engineering, appraisal, or legal documentation.
2. Client Responsibilities
You are responsible for preparing the property before the appointment. This includes:
Cleaning and decluttering
Removing personal/sensitive items
Staging if desired (PixelPoint does not offer staging services)
Securing pets and ensuring the safety and accessibility of the property
The photographer will photograph the property in its current state upon arrival. We do not move furniture, clean, or stage the home.
3. Cancellations, Rescheduling & No-Shows
Cancellations must be made at least 24 hours in advance to avoid a $50 fee.
Rescheduling may be allowed at the photographer's discretion, especially in cases of weather or safety concerns.
No-shows or last-minute cancellations may be charged the full session fee.
4. Turnaround Time & Editing
Standard delivery is within 24–48 hours (Monday delivery for Friday shoots).
Rush delivery may be available for an added fee.
Standard edits include exposure, cropping, and color adjustments.
Advanced edits (object removal, virtual staging, sky replacement, twilight conversion) may incur additional fees and longer turnaround times.
5. Copyright & Licensing
All media is copyrighted by PixelPoint Photography. A limited, non-exclusive, non-transferable license is granted to the original paying client (listing agent/property owner) to use the media for marketing the specified property during the listing period (up to one year).
Media cannot be shared with third parties (other agents, homeowners, builders, etc.) without written permission.
Primary images may be used after the listing for “sold” announcements.
Extended or commercial use must be negotiated separately in writing.
6. Floor Plan & Measurement Disclaimer
CubiCasa floor plans are illustrative and for marketing use only. Dimensions are approximate and not to scale. We are not liable for inaccuracies. Clients should consult licensed professionals for verified measurements or documentation.
7. Drone Services & Boundary Disclaimer
Aerial services follow FAA Part 107 rules. Any boundary markings or lines in drone images are for visual reference only and are not legally binding. PixelPoint is not liable for misinterpretation of aerial visuals.
8. Pet & Personal Safety
Please ensure pets are secured and the home environment is safe and accessible. Unsafe or inappropriate environments may result in session cancellation without refund.
9. Payment Terms
Payment is due upon delivery unless agreed otherwise in writing.
Returned or disputed payments may suspend services and incur legal action.
10. Use of Media by PixelPoint
We reserve the right to use any media for promotional purposes including website, social media, or printed materials unless the client opts out in writing before the session. Once media is published by the client (MLS, social, etc.), we may also use it unless otherwise prohibited in writing.
11. Limitation of Liability
PixelPoint is not liable for indirect or consequential damages, including but not limited to inaccuracies in features, conditions, or measurements. All media is provided “as is” for marketing only. Maximum liability shall not exceed the total paid for the specific service.
12. Right to Refuse Service
We reserve the right to cancel or refuse service due to:
Unsafe or unsanitary conditions
Inaccessible properties
Harassment or inappropriate conduct
FAA or weather restrictions for drone work
13. Privacy Policy
We collect client information only to process bookings and communicate about services. Data is securely stored and never sold or shared except when required by law.
14. Modifications
We may revise these terms at any time without prior notice. The most current version is available on our website. Continued use of our services constitutes acceptance of any changes.
